Establishment Program
This Establishment Program assists adults with developmental disabilities and their families or friends to
pay legal costs up to $500 associated with establishing a guardianship and/or conservatorship appointment.
The person for whom the guardianship/conservatorship is to be established for must be at least 18 years of age and
have a documented developmental disability pursuant to SDCL 27B-1-18. In order to be considered, an application must be received before a
guardianship/conservatorship is established. This funding is limited to first time appointments only.
Funding is limited to up to $500 for legal costs; any amount over $500 must be provided through another source.
Funding for this program is limited and granted on first come, first served basis.
The department will not accept any application submitted more than three months prior to the individual's 18th birthday.
Funding is also dependent on an annual appropriation by the legislature.
