Guardianship/Conservatorship Services

Through the Department of Human Services


Minimum Criteria for Application

The Applicant MUST:
  1. Be 18 years of age or older.
  2. Have a documented developmental disability as defined in 27B-1-18.
  3. Be receiving services or financial assistance from the Department of Human Services (DHS) as defined in 29A-5-110.
  4. Have no other individual or entity qualified and willing to serve.
Application Process

  1. Complete the application as thoroughly and as neatly as possible on behalf of individual.
  2. Submit written documentation that the individual does not have any family members, advocate, or other qualified and willing to serve.
  3. Submit the individual's most recent Individual Habilitation Plan, Social and Medical History.
  4. Submit documentation of all least restrictive alternatives that have been attempted.
  5. Submit documentation of the interdisciplinary team's discussion regarding the individual's need for guardianship/conservatorship services.
  6. Submit evidence in which the consumer has not been able to make informed consent decisions in the past.
  7. Submit documentation describing the specific reasons/circumstances that lead to why the team is applying for guardianship/conservatorship services now.
  8. Submit the most recent psychological evaluation or submit a written document from a psychologist that documents the applicant's inability to make informed decisions, including specific areas of incapacity.
